Timothy Busfield's Child Abuse Case Dismissed: Why the Indictment Was Tossed and What Happens Next

Timothy Busfield’s legal case took a sharp turn this month when a New Mexico judge dismissed the indictment against him. The actor and director had been facing four counts of criminal sexual contact of a minor after a child actor on Fox’s The Cleaning Lady accused him of inappropriate touching between late 2022 and early 2024. He surrendered to authorities in January 2026, pleaded not guilty that February, and had a trial scheduled for May 2027.

The dismissal didn’t come from a jury verdict or a lack of evidence. The judge cited prosecutorial misconduct and errors in the grand jury process, meaning the case fell apart on procedure rather than on the facts. That leaves prosecutors with a decision to make: seek a new indictment, or let it go. A second accuser has also come forward, alleging Busfield assaulted her in Sacramento roughly 25 years ago when she was 16.

Busfield has denied all allegations from the start, and his wife, actress Melissa Gilbert, has remained publicly supportive. The dismissal is a pause, not a conclusion, and the court of public opinion is still very much in session.

Do you think prosecutors should refile the charges, or is this case done?
