The restraining order case between Halle Berry and ex-husband Olivier Martinez is getting more personal. Berry’s 18-year-old daughter Nahla, from her previous relationship with Gabriel Aubry, is listed as a potential witness and would testify virtually because she’s attending school. In an earlier declaration, Nahla said she never witnessed her mother hit, slap, choke, grab, or physically abuse her 13-year-old brother Maceo.

The testimony part already got heavy. Maceo himself testified for nearly four hours on Monday, and Berry appeared emotional afterward. Both Berry and Martinez, both 60, are expected to testify. Martinez’s legal team argued that Nahla’s declaration was riddled with hearsay and asked that it not be entered as evidence, while Berry’s team called his restraining order application frivolous and baseless. Judge Shelley Kaufman is keeping the courtroom closed for anything involving Maceo or sensitive medical issues.

The hearing resumes Tuesday at 10:30 a.m., so there’s more to come. In the meantime, the bigger conversation is about how much of a family’s private life ends up on the record in cases like this. Do you think kids should ever be called to testify in their parents’court battles?
