Halle Berry's Ex Olivier Martinez Seeks Sole Custody, Accuses Her of Abusing Their 12-Year-Old Son

Halle Berry’s ex-husband Olivier Martinez has filed court documents seeking sole custody of their 12-year-old son, Maceo, accusing the actress of physically attacking the boy on Sept. 26, 2026. Martinez is also requesting a domestic violence restraining order against Berry. The filing marks a major escalation nearly three years after the former couple’s divorce was finalized in 2023.

Berry’s attorney, Marina Beck, responded by calling the filing“entirely meritless and deliberately misleading,”signaling that Berry plans to fight the claims in court. Martinez’s attorney, Patrick Baghdaserians, said his client believes Berry“should get appropriate help so she can address the issues raised in the dispute.”Berry and Martinez married in 2013 and have shared legal custody of Maceo since their split, with Berry paying $8,000 per month in child support plus school costs.

The case raises difficult questions about how domestic violence allegations are handled in custody disputes, how much of a family’s private life should play out publicly, and what happens when two parents offer a judge completely different accounts of the same night. No court has ruled on the allegations, and both sides are entitled to their day before a judge. The custody arrangement could now head back to court for the first time since the divorce.
