Sunny Hostin usually does the talking. This time someone called her. On The View’s companion podcast, Hostin shared that Cynthia Erivo phoned her from Paris after a View segment on the Cornell case drew heavy backlash online. During that segment, Hostin explained why the district attorney declined to charge the seven accused men, walking through New York’s consent statute without first stating that she disagreed with the outcome. Plenty of viewers heard something very different: what sounded like a defense of the accused.

Erivo’s message was direct and affectionate. She told Hostin she knows who she is, knows her life’s work has been about protecting women and children, but that the clip didn’t reflect that. Erivo’s suggestion was simple: lead with empathy, then let the legal explanation land. Hostin restructured her next discussion of the case accordingly, putting the human stakes ahead of the statute.

The underlying argument matters too. Hostin, a former sex crimes prosecutor, calls New York’s intoxication standard for consent terrible and says the law itself needs changing. She also rejected claims she was victim-shaming. Seven Cornell students were accused of drugging and assaulting a classmate in October 2024, and Jane Doe has since sued the men, a fraternity, Cornell and her former sorority. So here’s our question: when a case is this fraught, does the order of the conversation change how the message gets heard?
