Restraining Order Denied: Taylor Frankie Paul Speaks Out on Custody Fight

When a court filing lands on a Friday in early July, the emotional fallout often hits harder than the legal verdict. That’s exactly what happened to Taylor Frankie Paul, 32, after her ex Tate Paul’s attempt to restrict her access to their two children was shot down by a Utah court just one day after he filed.

On Friday, July 3, the reality star took to Instagram Stories to detail the emotional toll of the custody dispute. The immediate issue: her children, daughter Indy, 8, and son Ocean, 6, had just returned after being withheld from her, and she’d promised them an extended Fourth of July weekend with fireworks. Then Tate allegedly reversed course, leaving her kids confused and heartbroken.“Their dad even told me we could EXTEND it to Monday so I relayed them the exciting news just for him to take it back?”she wrote.“It was lies to them and my gut was wrenching to witness them cry, confused and asking why…”

The restraining order filing came on Tuesday, June 30, when Tate submitted his petition to the Utah court alongside a request to modify their existing divorce and custody agreement. But the judge wasn’t persuaded. Court documents obtained by Us Weekly on Wednesday, July 1, painted a clear picture:“As Tate himself recognizes, many of his supporting allegations are based upon inadmissible hearsay, without any corroborating evidence.”The filing also noted that while concerns about the children’s school performance and emotional wellbeing might warrant attention, an emergency custody order wasn’t the solution. The court pointed out that Tate had left the children with Taylor from June 11 through June 17, 2026, while he traveled to Iceland—hardly the behavior of someone genuinely fearful for their safety.“The court cannot find an immediate and irreparable harm as contemplated by Rule 65A, and the motion is denied.”

What complicates the picture further is Taylor’s separate legal entanglement with ex-boyfriend Dakota Mortensen, with whom she shares son Ever, 2. The two exchanged temporary restraining orders following domestic disputes, adding another layer of custody complexity to her life. It’s against this backdrop that Taylor revealed—via sources speaking to Us Weekly—that she recently checked into a rehab facility voluntarily for mental health treatment on her doctor’s recommendation. She’s since been cleared and discharged, with her focus firmly on her own healing and parenting.

In her Instagram Stories, Taylor connected these dots herself, hinting at the catch-22 she feels she’s trapped in.“I had my kids taken for doing the right thing… why would I ever ask for help again?”she wrote, emphasizing her sobriety and claiming she’s being controlled by her exes.“This is abuse by proxy,”she alleged, describing what she characterized as coercive control from an unnamed former partner who she said used her disclosures against her.

Tate has filed a motion for reconsideration with additional exhibits, signaling this fight is far from over. But for now, the court’s message is clear: allegations without evidence and missed fireworks don’t change custody orders. What remains unclear is whether the emotional cost to her children will ever be fully accounted for in legal documents.
