A Halloween night in Duncan ended with a former Stephens County judge behind bars. Jerry Herberger, 73, was booked into the Stephens County jail on charges of assault and battery with a deadly weapon, attempted murder, and possession of a firearm while intoxicated. Police were called to Linwood Lane around 8:02 p.m. Saturday after witnesses reported that an intoxicated Herberger threatened trick-or-treaters and fired a round in the children’s direction while holding a gun.
According to the Duncan Police Department, Herberger also pointed a firearm at a responding officer before complying and exiting his home. No one was reported injured, and the City of Duncan said everyone involved is safe. Police thanked the witnesses who stepped up and helped officers during the investigation.
Herberger was appointed special district judge in Stephens County in 2011. As of 12:30 p.m. Tuesday, no formal charges had been filed in Stephens County District Court, so his next steps will play out through the legal process in the days ahead.
